“Swargbndhan.com” is owned and operated by MB TECHNOLOGIES. The Site ishereinafter collectively referred to as “Platform”.

The Company offers its services and products to you via the Platform, provided that you comply with these Terms and Conditions, as they may be updated periodically. If you do not agree to the Terms and Conditions or fail to comply with them, you should not use or access the Platform or avail of the Company’s services or products through it. 

The Platform is an intermediary as defined under sub-clause (w) of Section 2 of the Information Technology Act, 2000. Visitors to the Platform are granted a nonexclusive, limited license to use and access the content and services offered in accordance with these Terms and Conditions (the "License").

Any visitor to the platform whether or not they have paid for access or services, including general browsers, whether registered or not are hereinafter referred to as “User/Users.”

By engaging in positive actions on the platform, the user consents to be bound by the terms and conditions outlined below ( “Terms”). If a user does not agree with any of these terms and conditions, they should not access or use the platform.

It is generally understood that when someone creates a profile for another person on the Platform, the person creating the profile is presumed to have received implicit consent from the individual on whose behalf they are acting, authorizing them to create the profile. However, the individual whose profile is created may request the deletion of that profile at any time. Please be advised that the Company/ Platform does not promote the creation of profiles without clear consent and retains the authority to deny access to the Platform.

The Platform is owned and operated by MB TECHNOLOGIES. hereinafter referred to as “ Company”), which term, for the purposes of this document, shall be construed to include its subsidiaries, affiliates, partners, shareholders, directors, executives, officers, employees, agents, attorneys, accountants, and any individual entrusted with any responsibility for tasks connected to the Company’s affairs, with its registered office presently situated at B/32, Shree Sai Deepak Apartment, Katemanivali, Kalyan East 421306, Thane, Mumbai, Maharashtra 

The Platform is meant solely as a preliminary means for Users with genuine intentions to form a matrimonial partnership (“Purpose”). The Platform does not claim to function as a marriage or business bureau, nor as a dating or contact website.

The company assumes that every User accessing the Platform intends sincerely to marry or enter into a matrimonial relationship and not for any other purpose. The Company will not be held responsible under any circumstances for any loss or damage arising from the use of the Platform, its services, any content posted on the Platform, or transmitted to Users. The sharing of matrimonial profiles via the Platform shall not be interpreted in any manner as a matrimonial offer or recommendation made by or on behalf of the Company. The Company shall not be held liable for any loss or damage to any individual that occurs before, during, or after matrimonial relationships formed as a result of using the Company’s service. 

The company gathers your personal information including, without limitation, your email address, physical address, first and last name, phone or mobile number, date of birth, age, gender, ethnic or cultural background, appearance, religion, occupation, preferences, lifestyle details, and general geographic location (“ User Data”)from users to allow them to build profiles on the Platform. In addition to this, other health-related detailssuch as physical and mental disabilitiesare also gathered. The collected User Data is input into a specially designed program that matches profiles and offers potential matches for Users according to their pre-selected partner preference criteria. User Data is shown only after obtaining prior consent from Users. The company does not gather financial information from Users, including credit card or debit card numbers, bank account details, or similar data. The company will not be able to grant access to the Platform and/or establish User profiles unless the necessary User Data is provided by the Users. The user hereby agrees to the use of their User Data being shown to other users on the Platform.

The Platform integrates multiple third-party apps to deliver a complete user experience. By using the Platform, you acknowledge and agree that you may be bound by the terms and conditions and privacy policies of these third-party apps. It is your responsibility to review these policies before using any linked services.

When you create a profile on Swargbndhan, some anonymized information may be viewable by external visitors. This information does not contain any personally identifiable information ( PII) unless you voluntarily decide to provide it. You have the ability to manage what information is shown and accessible via your account settings

User data is uploaded either directly by the users or via any of the Swargbndhan offline centers listed on the platform. The company may, at its sole discretion, choose to display all or part of any listing submitted by a user on the platform, or in any other mediaincluding matrimonial sections of other platforms, print media, community groups, websites, TV programs, DTH/IPTV services, mobile WAP sites, and similar outlets. Users and the Company shall not be held liable for the usage or publicity of such information/data, at no additional cost. 

Users agree not to duplicate, download, publish, modify, or distribute any content on the Platform unless explicitly permitted in writing by the Company. Users agree not to create any deep link or other direct connection to any specific page on the Platform without first obtaining the Company’s prior written permission. 

Users agree to use the Platform for personal purposes. Creating derivative works for commercial purposes using content from the Platform without the Company’s prior written consent is strictly forbidden. 

The Company takes measures including technological means on the Platform to exclude robots, scripts, programs etc. from crawling or scraping content on the Platform. Users undertake not to circumvent these methods.

Any advice, counselling, recommendations, or information offered on the Platformwhether from the Platform or from Users may not be accurate, true, or reliable. Users who rely on such content or take any action based on it do so entirely and solely at their own risk. By using the Platform, Users agree that access to the content is granted by the Company on an ‘ AS-IS ’ and ‘ AS-AVAILABLE ’ basis. Users who intend to rely on the information provided are encouraged to perform their own due diligence regarding the content on the Platform, at their own discretion, expense, and effort. The company does not advise or recommend that a User initiate any contact or interaction with other Users or anyone based on the data or information provided in such User’s profile, photograph, or other related materials. and the User choosing to establish contact or engage shall do so entirely at their own risk. The company cannot be held responsible or liable in any way for any reliance placed on any information displayed or posted on the platform, as such information merely serves as indicators of the general situation in the relevant area. 

The company does not verify, validate, screen, endorse, or investigate any information or claims contained in matrimonial listings or any other content on the Platform, nor does it in any way certify or guarantee that such information is accurate or true. It does not endorse any matches or profiles in any way, but it is implied that Users assume the information they provide is intended solely to create or define a suitable profile for matrimonial purposes, aligned with the partner preferences they themselves have set. Those seeking to use any information on the Platform must exercise all due diligence, effort, and initiatives, and should take appropriate precautions, fully aware that all information in matrimonial listings has been posted directly by Platform users without prior notice, consent, or verification by the Company. 

Users of the Platform are prohibited from uploading, posting, transmitting, updating, or sharing any information that: 

Is owned by someone else and the user has no claim to it; 

is severely damaging, offensive, blasphemous, slanderous, indecent, sexually explicit, child-focused, defamatory, violating someone’s privacy, hateful, or racially or ethnically offensive, derogatory, connected to or promoting money laundering or gambling, or in any way illegal; in any manner, it causes harm to minors; 

violates any patent, trademark, copyright, or other proprietary rights; 

violates any law currently in force; 

misleads or deceives the recipient regarding the source of such messages or conveys information that is severely offensive or threatening; pretends to be someone else; 

includes software viruses or any other computer code, files, or programs intended to disrupt, damage, or restrict the functionality of the Platform; endangers the unity, integrity, defense, security, or sovereignty of India, undermines friendly relations with foreign countries, disrupts public order, incites the commission of any cognizable offense, hinders the investigation of any offense, or is offensive to any other nation. 

The Company may, at any time and in its sole discretion without prior notice, terminate or restrict a User’s access to the Platform ( or any part of it) and/or remove any content uploaded by the User, for any reason including, but not limited to, if the Company, in its judgment and perception, believes the User has breached or acted contrary to the letter or spirit of these Terms. 

The company offers an online platform that allows users to build their own unique profiles, including optional personal information, which will be displayed on the platform and may be used by users for the stated purpose. The company does not disclose User Data to other Users or third parties without the User’s prior consent. Although the Company will take all reasonable precautions, it will not be held responsible if User Data displayed on the Platform is unlawfully copied, printed, published, forged, superimposed, or manipulated, among other actions. or improperly used by any User. Users agree to compensate the Company for all losses or damages it may incur due to any activities conducted by them through improper use of the Platform or services provided by the Company. 

By posting a matrimonial profile, business or personal listing, link, or any other content or listing on the Platform, the User who creates or uploads such content, and any person or persons responsible for such posting or listing, shall be deemed to have agreed to indemnify and hold the Company harmless from any lawsuit, complaint, civil, financial, or criminal claim, and from any damages or liabilities ( including, without limitation, interest, fines, and penalties) that may arise from or relate to such posting or listing, or any response received in connection with it. 

While using the Platform, Users are required to provide only accurate and truthful information, and when creating a profile, they must ensure that this information remains current at all times. The company does not guarantee or approve the accuracy or reliability of any member or visitor profile, advice, opinion, statement, or other information displayed or uploaded via the service by the company. Neither the company nor any of its owners, employees, or agents shall be held liable under any circumstances for any action or displaywhether direct or indirectthat arises from the online presentation of information deemed illicit, offensive to visitors or members, or plainly offensive to the online community, or any content that promotes racism, bigotry, hatred, or physical or mental harm toward any group or individual, or that transmits chain letters, junk mail, unsolicited mass mailings, spam, or obscene material to other users or members. 

The Company does not monitor the behaviour of Users and therefore assumes no responsibility for any actions taken by Users who may access or use the online service provided by the Company to harass, abuse, or harm other Users, or to promote, advertise, or solicit anything without the prior consent of others, or to engage in any activity that may jeopardize the safety of other Users. 

The company reserves the right to remove or delete any content, message, photo, profile, or to cancel a User’s registration or membership either upon receiving a complaint from another User or upon its own discovery, or based solely on its judgment and perception. It may, without prior notice, immediately terminate the service granted to the User, forfeit all associated incidental services, reclaim any registration fees or tenure, and pursue appropriate legal action against the User.

By posting a profile on the Platform, the User is considered to intend to marry. If the Company determines that, at the time of posting or afterward, the User had no such intention or later changed their mind, the Company reserves the right to remove or delete the profile and may pursue legal action or take other measures as deemed appropriate from time to time. By using the Platform, the User is deemed to agree not to post any content or views that may be deemed threatening, abusive, vulgar, obscene, or otherwise offensive, or to act in a way that harasses another user; to provide false or misleading information in any part of their profile; to impersonate someone else or use the site for commercial purposes; or to interfere with or disrupt the site’s operation, or to disregard any reasonable requirements, procedures, or policies established by the Company from time to time.

We use both proprietary and third-party AI tools to detect and tackle harmful content on our platform. These tools are built to make reasonable efforts to identify violations of platform policies and relevant laws, including harmful conduct like speech that breaches our platform rules. Automated moderation can function either fully automatically or under human supervision, based on the content’s complexity and the organization’s internal policies. Depending on the output of technological moderation, content may be approved, rejected, or forwarded to human moderators for a second review. These tools depend on third-party services to deliver detection and moderation features.

Nothing in the Platform is intended or designed to encourage, persuade, convince, or invite any individual to take any action or refrain from taking any action, where such action or inaction would violate any law or regulation currently applicable to that person or activity. 

The company will not be held accountable for any interactions or exchange of information, etc. The Company has no obligation to monitor any disputes that may arise between Users via email, chat, or any other medium, and shall not be involved in such disputes or litigation.

The Company reserves the absolute right, at its sole discretion, to modify, amend, or remove any content posted in matrimonial listings on the Platform in any way it sees fit, to ensure compliance with the applicable rules for such listings ( which may include, without limitation, the Company’s efforts to boost response rates to matrimonial listings), apparent accuracy, and current applicable lawsparticularly those prohibiting indecent, unlawful, or obscene material. The company retains the absolute right to remove any profile if it discovers that the same individual has created multiple profiles on the Platform. Even if multiple profiles have been created using identical contact information, the Company retains the absolute right to delete all such profiles. If any member declines to provide consent for physical address verification as requested by the Company, the Company reserves the absolute right to delete the profile. 

Websites linked on the Platform and their contents are the exclusive responsibility of their respective promoters. The Company does not, in any way, recommend, authenticate, endorse, verify, or certify these websites, their contents, or any associated links. 

The company does not assume responsibility for the privacy practices of other websites and therefore recommends that users review the privacy statement of every site they visit. The company makes no warranty and does not support the accuracy or legitimacy of other online services listed on the Platform, which may include activities like lucky draws, free trip giveaways, free ticket contests, astrology, palmistry, or numerology. By clicking on and navigating to any other website(s) or links shown on the Platform, the User accepts full responsibility and assumes all associated risks. Users must always keep in mind that clicking or selecting such links or websites establishes a direct connection via their own Transmission Control Protocol (TCP) and Internet Protocol ( IP) network, not through the Platform’s IP address. The company does not recommend or encourage Users to share personal information particularly their Profile ID or User Name with this or any other website. 

The Company expressly disclaims any liability, warranties, or guarantees whether express, specific, or implied that may arise in any way related to the existence, promotion, promotion efforts, content, links, information, or discontinuation of the Platform. No claims for damages, restitution, lost profits, or any other financial, civil, or criminal grievances whether arising from or connected to any aspect of the Platformshall be valid or enforceable against the Company. 

The company does not assume any responsibility for errors, omissions, interruptions, deletions, defects, delays in operations or transmissions, failures in communications lines, theft, destruction, or unauthorized access to, or alterations of, user communications. The company is not liable for any issues or technical failures related to telephone networks or lines, computer systems, servers, providers, equipment, software, email disruptions, or player malfunctions whether caused by technical problems or internet congestion nor for any harm or damage to users or others’ computers arising from participation or downloading content from the Platform.

Users visiting the Platform are categorized by Company as either having incomplete or complete profiles. Both of these types could also be either free or paid members. The company retains the absolute right to modify, amend, alter, restrict, or extend any privileges, rights, benefits, liabilities, or responsibilities for all types of paid and free users, as it sees fit, and such changes will immediately apply to all past, present, and future users. The company grants free users certain benefits and privileges, such as the ability to initiate free contact through the " Express Interest" feature and to view the contact details of paid users under specific conditions, among other things. The amount of these benefits, as well as the benefits overall, will be determined entirely at the Company’s discretion. The company will decide at its own discretion how many benefits to provide to each free User. The company will provide varying levels of benefits to different free users at the same time. Access for free users will be limited through multiple methods, such as access restrictions, spam filters, and quotas. 

Payments for services provided through the Platform must be made in full in advance. Once a User subscribes to a service, the payment is non-refundable, and all amounts paid will be considered final. Any refund, if applicable, will be at the Company’s sole discretion and it makes no guarantees regarding the accuracy or timeliness with which refunds will reach the User’s card or bank account. The company does not guarantee server uptime or that applications will function correctly. All is done on a best-effort basis, and the Company’s responsibility for losses, damages, or claims arising under this agreement is limited to refunding the amount paid. The company assumes no responsibility for free services. The company reserves the right to modify, alter, or change all or any disclaimers or these Terms at any time without providing prior notice. Any reference to terms or disclaimers whether explicitly stated or not shall be considered to include them. By continuing to use the Platform, a User is deemed to accept the amended Terms

The User is solely and exclusively responsible for keeping their password and user identification confidential, as well as for all activities and transmissions conducted through their user identification. The User bears full responsibility for any online or offline transactions involving credit cards, debit cards, or other instruments or documents used for such transactions. The Company accepts no responsibility or liability for any misuse of information related to the use of credit cards or debit cards by the User, whether online or offline. The company takes reasonable precautions to ensure that all data or information remains secure and does not fall into the wrong hands. The vulnerability in credit card transactions lies in securely storing data after receipt; thus, the company does not store or retain credit card, debit card, or bank account information. To ensure the highest level of security for a user’s financial information including credit card, debit card, and internet banking details all online payment transactions are processed directly through the secure platforms of payment gateways, not on the Platform itself. 

The company does not guarantee that the Platform will be uninterrupted or error-free. The company offers the service on an " as is" basis. However, the Company will take all reasonable steps to ensure its users receive a seamless, error-free experience. The Platform may experience delays, omissions, or interruptions in its availability. Users recognize that using the Platform is entirely at their own expense and risk. The company is not liable for any suspension of services on the Platform, regardless of the cause. The company reserves the right to discontinue or modify services on the Platform or their availability at any time, and users may also choose to cease using those services at any time. 

The Company relies on third-party payment gateways through the Platform, and any failures in these gateways will be communicated to users as they occur. Any additional currency conversion fees, charges, deductions, or errors arising from the payment gateway shall not be the Company’s responsibility.

The company holds full rights to the Platform and all services offered through it. The Platform includes, to the extent permitted by applicable laws, copyrighted content, trademarks, and other proprietary information belonging to its owners and licensors. Except for information that is already in the public domain or any use/ display for which permission has not been granted by the Company, the Company retains the right to take appropriate legal action under applicable laws against any unauthorized copying, modification, publication, transmission, distribution, performance, display, or sale of such proprietary information.

The company retains the right to confirm the authenticity of any Content posted on the site. If circumstances require, the Company may request any of its Users to submit documentary or other forms of evidence verifying the information or User Data posted on the Platform. The User must comply without objection and provide such evidence. Should the User fail to do so within a reasonable or specified timeframe, the Company may, at its sole discretion, terminate the User’s profile or access to the Platform, forfeit any advance payment without refund, and take any necessary actions permitted under applicable law. The company also reserves the right, at its own discretion, to investigate and pursue appropriate legal action without limitation against any user who violates or misuses the online services, and may terminate such user’s profile or access to the platform without prior noticeespecially if their use of the platform damages the platform’s or the company’s reputation or undermines its operations or interests.

The Company does not assume responsibility for any content posted by its Users on the Platform, including copyrighted material, trademarks, or other proprietary information, unless prior written permission has been obtained from the rightful owner. If the Company becomes aware of any infringement, the User may be requested to provide evidence or relevant details supporting the display, such as an electronic or physical signature of the person authorized to represent the copyright owner, a description of the allegedly infringed work, or a written statement affirming that the User believes in good faith that the content does not infringe copyright or that the User is liable for perjury if the information provided is later proven false, or a declaration that the content is accurate and that the User is either the copyright owner or authorized to act on behalf of the owner.

The company is not required to monitor the activities of its Users. However, the Company may monitor the Platform electronically from time to time and may disclose any information as needed to comply with applicable laws or regulations, to fulfillgovernmental requests, to ensure proper operation of the Platform, or to protect itself or its Users. The company also reserves the right to decline to post or to remove any information or materials whether in full or in part if, in its sole judgment, they are deemed unacceptable, undesirable, or in violation of applicable laws. 

Each member of Platform is limited to a specified number of contacts they may initiate using the "Express Interest" feature on the Platform.

If the Company receives any incriminating evidence or complaint about a User from other Platform users, or if the Company, using data from its servers, suspects misconduct by any User, it may impose account restrictions. These may include, but are not limited to, limiting the User from initiating multiple contacts and restricting them to only contacting members whose profiles match their desired partner criteria.

Company guidelines forbid members from providing their name and/or contact information in any form such as email or phone numbers. IDs, postal addresses, and similar details in any fields other than the designated ones where such information is requested. If any member enters the above information into a field not intended for that purpose, the Company’s screening team will remove it.
